O P I N I O N OF T H E A D V O C A T E GENERAL
Mr Advocate General Jacobs delivered his Opinion on 17 May 1990. * H e proposed that the Court should declare that, by omitting to comply with Articles 3(2) and 12 of Directive 75/442/EEC, Article 10 of Directive 76/403/EEC and Articles 12(2) and 16 of Directive 78/319/EEC, the Italian Republic had failed to fulfil its obligations under the EEC Treaty, and order the Italian Republic to pay the costs.
