OPINION OF THE ADVOCATE GENERAL

Mr Advocate General Jacobs delivered his Opinion on 23 October 1990. * He concluded that the Court should:

(1) Declare void the Commission's decision of 8 May 1989 deducting ECU 55 451.50 from the amount due under the tender;

(2) Order the Commission to pay the costs.
